Judicial Separation

During the time of marriage, if conflicts between husband and wife reach a point where they cannot live together, either party can apply for judicial separation under Section 10 of the Hindu Marriage Act.

Maintenance for Wife, Children, and Parents — Section 125 CrPC

When a person neglects or refuses to maintain his wife, children, or parents, the wife can file an application before the Magistrate under Section 125 Cr.P.C. In such cases, she is entitled to maintenance that matches her husband’s standard of living.

Maintenance During Litigation & Expenses of Proceedings

Under the Hindu Marriage Act, if during legal proceedings one spouse lacks independent income sufficient for support, the court may order the other spouse to pay monthly maintenance and cover litigation expenses.
