COURT MARRIAGE UNDER SPECIAL MARRIAGE ACT - 1954

For solemnization of marriage under the Special Marriage Act-1954, the presence of both parties is required twice — once at the acceptance of notice and second at the solemnization of marriage after 30 days. A copy of the notice is displayed on the notice board of the Registrar of Marriage (Delhi Government). Any person within 30 days of issue of notice may file an objection to the intended marriage. The Marriage Officer shall not solemnize the marriage until any objection is resolved. In case no objection is received, the Marriage Officer will solemnize the marriage as per law. Both parties, along with 3 witnesses (Delhi residents), are required to be present on the date of solemnization. It is advisable to bring all originals during appearance before the Registrar.

Required Documents Under Section 8 Of The Hindu Marriage Act-1955 Are As Follows:
DOCUMENTS REQUIRED FOR MARRIAGE UNDER THE SPECIAL MARRIAGE ACT-1954:
  1. Documentary evidence of date of birth (Matriculation Certificate / Passport / Birth Certificate / Driving License). Minimum age: 21 years (male), 18 years (female).
  2. Election Card and Aadhar Card of both parties.
  3. Separate affidavits from bride and groom stating date of birth, marital status, and nationality. (Affidavits will be prepared by us.)
  4. Four passport-size photographs of each party.
  5. Three witnesses (from any side) with PAN, Voter, and Aadhar Cards.
  6. Affirmation that the parties are not related within the prohibited degree of relationship (not blood-related).
  7. Divorce decree/order in case of divorcee, or death certificate of spouse in case of widow/widower.
  8. If one party is a foreign national, a No Objection Certificate from their embassy regarding marital status is required.
